City attorney: Appeals dismissed in revenue bond case; Superior Court issues 'Bill of Peace' against frequent litigants

Port Wentworth, Ga. — City Attorney Scott Robichaux updated the council on two legal developments on April 16: the Georgia Court of Appeals ruled for the city in a revenue bond appeal and the Superior Court issued an order commonly called a 'Bill of Peace' against parties identified as the Bentons.
Robichaux said the Court of Appeals found the appellants lacked standing, dismissed the appeal and denied a motion for reconsideration. He told the council the matter will be remitted for further procedural steps consistent with the court’s ruling.
Robichaux also reported the Superior Court granted a 'Bill of Peace' against the Bentons after a documented history of repeated and unsuccessful litigation filings against the city and other entities; under that order the Bentons must obtain court approval before filing any new lawsuits, counterclaims or related legal actions. Councilman Thomas Barbee asked whether the order is public information; Robichaux said it is.
