On July 24 the Board of Adjustment and Appeals approved variance 16‑2026, allowing an interior sideyard setback of 3.97 feet (in lieu of the 5‑ft requirement) at 2374 Landing Drive in the Brooks Landing phase 2 subdivision.
Staff recommended denial, saying the lot (approximately 5,893 sq ft) was created as part of the approved subdivision and did not appear to have unique physical characteristics distinguishing it from other lots; however, the applicant obtained and recorded a partial release from the homeowners association that reduced a private drainage easement from 5 ft to 3 ft along the affected property line. Staff reported the easement release was recorded with the Brevard County Clerk of Courts and that the plot plan otherwise complied with the plan development standards.
Chrissy Inisencio, who identified herself as representing the owner and builder (Ryan Holmes), said the requested relief was minor — just over one foot — and necessary to allow a standard 40‑ft home product already sold on the lot to be built. She asked the board to approve the variance to allow the permit process to move forward.
Board members voted unanimously to approve the variance; staff will continue normal permit reviews, and the applicant will proceed with required inspections.
Next steps: applicant to obtain permits and complete construction under normal plan review and inspection processes.
