The Berkeley County Planning Commission voted to grant a waiver of the private unpaved‑road standards (chapter 59‑45) to allow a proposed seven‑lot subdivision accessing Truth Way in Council District 8.
Staff explained the waiver request from Henry and Richard Nixon (applicants gave their names on the record) and described the county standard that would normally require improvements once a shared access serves more than 10 lots. The applicants said Truth Way would be required to meet a 30‑foot ingress/egress standard and they had instructed their surveyor to allow for a 50‑foot right‑of‑way where appropriate. Applicants Richard Dixon and Henry Dixon told commissioners that Dixon Lane measures about 25 feet and that the proposed internal lot surfaces are currently rock. The applicants acknowledged that no formal drainage study had been completed for the proposed improvements.
After questions from commissioners about road width, surface type and drainage, no members of the public spoke in opposition during the allocated public comment window. A motion to approve the waiver passed by voice vote and staff announced the applicant’s waiver had been granted. Staff reminded the commission and the applicants that if the waiver had been denied the applicant would need to improve the shared travelway to meet private unpaved‑road standards or would not be able to subdivide.
