Commissioners adopt ordinance vacating portion of alley in Town of Cuzco

The Dubois County Commissioners held a public hearing and adopted Ordinance No. 2025-06 to vacate part of a 10-foot alley in the Town of Cuzco.
Phil Buehler of Brosmer Land Surveying and Engineering, representing landowner Larry W. Sullivan, presented a petition to vacate the section of alley north of Lots 6, 7 and 8. The ordinance states the alley has never been developed, is currently used as private yard or wooded area, is not necessary for access or orderly development, and vacation would not impede access to public buildings. The board found proper notice had been given, including certified mail to abutting landowner Robert Ralph Schaber.
The ordinance vests title in the adjacent property owner (listed as Larry W. Sullivan in the ordinance), preserves any existing public utility easements, directs the auditor to file the ordinance for recording, and advises aggrieved persons of a 30-day right to appeal in the Circuit Court of Dubois County. The ordinance was duly passed and adopted on July 7, 2025.
