Duchesne County delays final hearing on Ordinance 26-432 to allow staff revisions

Community Development Assistant Director Mike Gottfredson told commissioners that Ordinance No. 26-432 "amends the Duchesne County Code in five ways," including bringing local rules into alignment with 2026 SB 284 and establishing a single land-use appeal authority.
The ordinance as presented would: (1) update hearing requirements for appeals and variances to match state law; (2) change the standard of review for local appeals; (3) create a single county appeal authority for land-use decisions; (4) consolidate planning personnel and administrative body names in county code; and (5) update Utah Code references to current naming conventions. Gottfredson said the Planning Division assistant director and county attorney are completing a reviewed draft.
Gottfredson noted the Duchesne County Planning Commission opened its public hearing on June 3, 2026, and recessed it to July 1, 2026 to permit staff drafting and attorney review. At the Commission meeting on June 8, commissioners voted to recess the county public hearing until July 13, 2026, at 1:00 p.m., giving staff time to present the revised ordinance and allow further public comment.
The decision to recess was procedural; no final policy changes or votes on the ordinance were taken at the June 8 meeting. The matter will return to the Planning Commission on July 1 and to the County Commission for the continued public hearing on July 13, 2026.
