Canton acting mayor appointed to fill vacancy; special election set for November

The Canton City Council on July 13 accepted Mayor Nick Prestby’s resignation effective that day and approved a resolution filling the vacancy with Acting Mayor Cindy Shanks for the remainder of the term through Dec. 31, 2022.
Acting Mayor Shanks read Resolution 2022-09 accepting Prestby’s resignation and Resolution 2022-10 indicating her desire to fulfill the remainder of the term; council approved both resolutions by motion. Because Shanks’ appointment creates a council vacancy, the council approved Resolution 2022-11 establishing a process to fill that seat by appointment for the remainder of 2022. Letters of interest will be accepted from qualified residents through Aug. 1, 2022 at noon; the council will consider appointment during its Aug. 10 regular meeting.
Clerk Brock Bergey told the council the special election to fill mayor (and to fill the two council seats up for election) will be held in conjunction with the Nov. 8 general election, and that the filing period runs Aug. 2–Aug. 16. Outside the public comment period resident Mike Wilder asked whether the council had authority to appoint a mayor; Bergey referenced state statutory language that governs the process. The minutes do not include recorded vote tallies for the resolutions.
