Highland approves contingency legal agreement for AFFF product-liability litigation

The Highland City Council approved a legal services agreement on May 5 to participate in AFFF (aqueous film-forming foam) product-liability litigation under a contingency-fee arrangement.
City Attorney Trent Carriger and City Manager Chris Conrad described AFFF as a synthetic firefighting foam linked in studies to carcinogenic compounds and environmental contamination. Carriger said the city currently has minimal levels in its system but expects potential treatment costs in the future.
The contract is contingency-based at a one-third fee (33 1/3%) and carries no up-front cost to the city. City Manager Conrad said any recovery would be placed into reserves for the wastewater treatment facility.
The council voted unanimously to approve the legal services agreement at this meeting.
