City Attorney Nick Vivian told the Council that the matter traces back to a 2019 assessment appeal that proceeded through the district court and court of appeals. The courts determined the city was not authorized to assess that property for the referenced project and ordered reimbursement under the terms described in staff materials. "We’re simply honoring what the courts have ordered us to do in this case," Mayor Huber said, noting the agreement that led to the assessment predated the current council.
If the Council approves the resolution, the city clerk/administrator will forward the executed resolution to the county so the abatement process can be completed and funds remitted to the property owner. The Council opened the public hearing on the abatement, heard no speakers, closed the hearing and approved resolution 20246 by roll call.
The action implements the court’s directive; the transcript indicates the abatement relates to a preexisting assessment and that staff will follow through with the county to complete remittance. No additional city policy changes were proposed in the meeting record.
