The Town of Danvers Board of Health reviewed federal and state-authorized product lists for nicotine pouches and e-cigarette products and discussed next steps for local compliance enforcement.
Board materials presented at the Feb. 5 meeting noted that only certain nicotine pouches and e-cigarette products are federally authorized for sale and that Massachusetts’ menthol and flavor ban remains in effect. The board discussed confusion from highlighted product lists and said clarification is pending on specific entries.
The board discussed enforcement strategy for unauthorized products observed on retailer shelves. Materials and discussion proposed sending a sample reminder letter to retailers after the March meeting and suggested a grace period through June 30, 2026, with active enforcement to begin July 1, 2026. The board noted regular compliance checks occur about once or twice per year.
Members also raised concerns about nitrous oxide products found on local store shelves; the minutes state these products are outside the board’s regulatory jurisdiction but remain illegal and that police enforcement was recommended.
The board did not adopt a formal ordinance or motion altering local regulation at the Feb. 5 meeting; staff will return with clarifications and a proposed reminder letter following the March meeting.
