Council adopts temporary indemnity/permit approach for right-of-way mailboxes

The Independence City Council detailed a two-option approach for mailboxes located in the city right-of-way after staff received a complaint that some fixtures might not be breakaway and could expose the city to liability.
City staff said the options offered to property owners are to remove nonconforming mailboxes or to file a no-cost right-of-way permit and sign an indemnity agreement stating that the property owner (or their insurer) would indemnify the city if someone were injured and the mailbox was a factor. Staff explained the ordinance amendment includes a moratorium window — owners who submit the permit and indemnity agreement by July 1 will be allowed to retain their mailbox without paying fees; the intent is to record the condition, reduce city liability, and provide owners time to comply.
Staff described that the city attorney advised the indemnity approach after receiving photos showing mailboxes that might be non-breakaway. The city logged a case where an apparently non-breakaway mailbox was inspected and found to be a breakaway assembly; staff said that information likely would not have been recorded without the current outreach.
Council emphasized the approach is intended to limit city liability while providing residents time and options to resolve encroachments. Staff will administer the permit and indemnity forms and follow up on outstanding cases.
