Staff explained that formal nominations (due Sept. 26) indicate an intent to participate but are not legally binding until a later agreement is executed; however, the nomination process and related records may contain information protected by statutory confidentiality and non-disclosure agreements.
A motion by Pavich, seconded by Peterson, invoked the statutory exemption (section 22.7 subsection 50 as read into the record) authorizing a closed session to discuss confidential transmission-planning records and proprietary material. The board voted in favor on roll call and entered closed session to discuss the nomination and participation amount.
