The Agency City Council on Oct. 10 denied a request from the owner of Agency Auto to install a corrugated-metal privacy fence at 204 N Ann St. Council members expressed opposition to corrugated metal: Andrew Birch said "absolutely not," and Steve O'Brien said corrugated metal "was not an option." Mr. O'Brien moved to deny the request; Mrs. Ulin seconded. The roll-call vote recorded Ayes: Douglas, Deshler, Birch, Ulin and O'Brien, and the request was denied.
Following the fence vote, the council set a 30-day deadline for the property at 204 N Ann St to be cleaned up. If the owner fails to comply, Mayor Jake Johnson said the city could ask the city attorney to declare the location a nuisance. Mr. Birch proposed a 30-day deadline with conditions including removal of tires, cleaning of the dumpster area, and ensuring vehicles are within property limits. Ms. Deshler read aloud Chapter 3-2-1 of the city code as part of the record. The council approved the 30-day abatement deadline by roll-call vote (Ayes: O'Brien, Birch, Deshler, Ulin, Douglas).
The minutes instruct staff to send a nuisance letter to the owner by certified mail and to serve notice through the sheriff's office. The minutes do not record any appeal or compliance timeline beyond the 30-day deadline.
