Township and Paynesville officials discuss sunsetting annexation pact to speed renegotiation

Township and Paynesville representatives spent the bulk of their meeting discussing a long‑standing annexation agreement that several participants said inhibits development and complicates interaction with developers.

City representatives told the group that developers have expressed interest in land north of town but are limited by terms that require a developer to approach the township first. Participants said the current agreement—first signed in 2005 and revised in 2010—has not kept pace with development needs and leaves 'island' parcels (six properties) in a state where they are surrounded by city services but not annexed.

One attendee proposed establishing a 12‑month sunset on the current agreement to compel both parties to negotiate in good faith. Participants agreed a sunset could create urgency for talks but acknowledged homeowners in affected 'islands' might oppose annexation and that annexation remains contingent on property owners’ consent and statutory process. A township representative said annexation is "incumbent on somebody who owns that property wanting to come in," noting the city cannot legally approach owners to request annexation under the current terms.

The group did not take a formal vote. Instead, they agreed to meet again to develop a negotiated plan: attendees settled on a follow‑up meeting for Wednesday, June 3 at 6:30 p.m.; Clark and other staff were tasked with preparing maps, proposed language, and relevant background materials for that session.

Next steps: staff will prepare a map of parcels potentially affected by annexation, draft options for a renegotiated agreement, and circulate those materials to both bodies ahead of the June meeting.
