Commissioners reviewed the Benicia Fire Department's first annual performance report prepared under the city's industrial safety ordinance and discussed whether the commission should take on responsibilities previously handled by the Valero Community Advisory Panel (CAP).
City staff told the commission that the ordinance (citing section 8.55.250) requires the department to submit an annual performance review to this commission and then to the city council "on or before June 30 of each year." Staff said this submission is the department's first report under that requirement and explained why the department used a July 30 start date for the initial reporting period (the ordinance was adopted April 1, 2025, with a 120-day implementation period and fee adoption completed on Dec. 2, 2025).
Staff recommended two minor cleanup amendments to clarify the ordinance's reporting period and the fee due dates; any change would require council direction and formal ordinance readings. Staff also reported ideas raised by council members and the public, including proposals to expand the commission's responsibilities to take on some CAP roles and to be a public communication conduit with Valero about decommissioning and remediation matters. Staff emphasized these are preliminary proposals and would require legal review and formal ordinance amendments.
Commissioners raised operational concerns: how the commission would access combustible material inventory reports (staff said facilities must file inventories with county environmental health and the department can access the reporting software), the potential workload of absorbing CAP duties, and whether Valero would be willing to present regular updates. One commissioner referenced a March 26 incident reported in the news as involving "24 employees" taken to the ER after a flaring episode; staff said their review found no records of anyone sent to the hospital but allowed that people might have sought care independently without notifying employers or OSHA.
Staff said the council will discuss the proposals on June 23 and asked the commission for informal feedback the staff could pass to council before that meeting; if council directs changes, staff said amendments would come back for formal readings and public comment. No ordinance amendment or formal action was taken at this meeting.
