Montebello adopts Local Law No. 1 of 2026 banning potentially injurious fences in most districts

The Village of Montebello Board of Trustees adopted Local Law No. 1 of 2026, amending Chapter 195 (Zoning) to prohibit potentially injurious fences in most zoning districts.
The adopted text bars fences that incorporate elements "that could inflict bodily harm" — including barbed wire, razor wire, electrically energized wires, cut steel, sharpened glass or metal spikes — but exempts fences erected by public utilities or government entities and certain livestock fencing located at least 75 feet from property boundaries. The law includes severability language and a clause repealing conflicting village laws.
Village Attorney Warren E. Berbit presented the draft and noted the Planning Board recommended eliminating a PI exception and the Rockland County Planning Department suggested a numerical correction. No members of the public spoke during the hearing on this local law.
Deputy Mayor Stacy Caridi moved to adopt the local law (Resolution No. 26‑014), Trustee Bruce Egenhauser seconded, and the Board polled in favor: Mayor Lance N. Millman, Deputy Mayor Caridi, Trustee Egenhauser and Trustee David Rose voted to approve; Trustee Michael Humphrey was absent. The Board left the record open until March 1, 2026 for any non‑substantive corrections before filing with the Secretary of State.
