Tolland Conservation Commission discusses formal enforcement protocol with state regulator, approves minutes and sets next meeting

At the Jan. 29 meeting, the Tolland Conservation Commission discussed adopting a formal protocol to handle serious violations of the Wetlands Protection Act with Mark Stinson, who is listed in the meeting record as being of MASSDEP. Stinson outlined a five-step approach the Commission could use: (1) desktop review using AXISGIS/MASS Mapper to confirm proximity to wetlands, (2) drive‑by site visit by neighbors or from public property (the Commission instructed no drone use), (3) photographic documentation including images of any contractors on site, (4) issue a verbal stop order and follow with a written order to document the directive, and (5) issue an Enforcement Order/cease-and-desist when appropriate. The Commission noted that the burden of proof for enforcement rests with the TCC.
Following that discussion the Commission approved last month’s minutes (Dec. 18, 2025), scheduled its next regular meeting for Feb. 26, 2026, and adjourned at approximately 6:15 p.m.
Commissioners flagged the practical steps staff should use to document and enforce violations going forward and asked that these measures be formalized for consistent application.
