Board grants rear-setback variance for homeowner to build three-season room

Mark Geringer told the Fishers Board of Zoning Appeals that he seeks a variance to allow an attached three-season room approximately 15 ft from the rear property line at 8523 Legacy Court, where the UDO requires a 20-ft rear setback. He said the proposed construction will not encroach into an existing 10-ft drainage easement at the rear of the property.
Grace Wiley, senior planner for the City of Fishers, described the property as zoned TCR in the Heritage Meadows subdivision and cited UDO section 3.2.10.B.2.D as the relevant development-standards provision. Wiley said one public comment in support had been received and that staff had no recommendation for or against approval beyond suggesting the approval letter and related documentation be recorded with the Hamilton County Recorder's Office if the board approved the variance.
A board member asked whether similar reduction requests had been approved previously in the subdivision; staff said she did not know. No public speakers appeared for this petition. A motion to approve VA-26-5 with the recording condition was made, seconded and approved by roll call.
The variance permits the construction as presented, subject to the recording of the approval and documentation with the Hamilton County Recorder's Office.
