Buena Vista adopts temporary moratorium on data centers while land-use standards are drafted

The Buena Vista Board of Trustees on June 9 adopted Emergency Ordinance No. 2026-13, imposing a temporary moratorium on the acceptance, processing and approval of applications for data centers in the town while staff develops land-use regulations to address potential impacts.
Town Administrator Brian Berger told trustees that data centers are not currently defined as a specific use in the Town Code and that existing categories may not adequately address likely impacts such as water consumption, energy demand, noise and visual effects. Berger recommended a moratorium through Dec. 9, 2026, to allow staff time to develop regulatory standards and designate appropriate locations and review criteria.
Trustees discussed the scale of potential impacts and the need for near-term limits while preserving the town's ability to consider future proposals under clear standards. The Board adopted the ordinance by motion (Mover: Trustee Sturm; Seconder: Trustee Huyck). The minutes record the vote as Ayes: Huyck, Rice, Rosenoer, Rowe, Sturm, Swisher; the motion is recorded as carried.
