Council pursues DNR file for trail and EDA to cancel lease; land conveyance to Cornerstone State Bank may proceed pending review

During the Jan. 13 meeting, staff updated the council on efforts to locate an agreement between the city or a local baseball association and the Department of Natural Resources regarding a trail adjacent to the baseball park. Staff said DNR contacts agreed to look for the document and asked for about a week to search files. The agreement is being sought to clarify rights and responsibilities tied to the park/trail.
Separately, staff said the Economic Development Authority (EDA) will send a notice to Green Alliance to cancel a lease (30-day notice) for a bus garage and that the EDA has prepared a resolution to convey parcels to Cornerstone State Bank to facilitate deed and foreclosure matters. Staff provided legal descriptions for the lots and asked whether the DNR agreement needed to be in hand before the EDA moves forward; the city attorney said he would follow up and advise.
The council did not adopt a final conveyance at the Jan. 13 meeting; the matter was set for the EDA meeting the following day, and staff indicated the conveyance and lease cancellation would proceed there if legal review allows.
