Commissioners approve Legacy Pointe easement vacation and setback variance

Ethan Hopf of Tri‑Mark Surveying appeared before the commissioners on March 2 representing Sara and Bryant Niehoff and requested vacation of portions of a 20‑foot public utility and drainage easement and reductions to side and rear yard setbacks for Lot One of Legacy Pointe in Madison Township.
The board approved vacating the easement on the northside from 20 feet to 0 feet and on the westside from 20 feet to 14 feet. The commissioners also approved a setback variance reducing the north side yard from 10 feet to 9 feet and the rear yard from 20 feet to 14 feet. The record notes no remonstrators were in attendance. Motions to approve both the easement vacation and the variances were made, seconded and carried unanimously.
Hopf presented the petition on behalf of the property owners; the county did not record any objections in the meeting minutes. The planning and surveying information was taken under advisement and formal motions concluded the item during the same session.
