Zoning panel approves accessory structure across town road for Gross Family Trust

The Sawyer County Zoning Committee on a unanimous roll-call vote approved Conditional Use Permit (CUP) 24-16, permitting an accessory structure to be built on a parcel adjacent to — but across a town road from — the primary dwelling owned by the William and Jane Gross Family Trust.
The structure proposed is a wood-frame pole shed roughly 59 by 62 feet with a lean-to for storage and a small workshop; the applicant, David Tamy Hubler of 12173 N Wagner Circle, said the building will be used to store a 30-foot travel trailer, boats and a UTV and "not for commercial or residential use." Hubler told the committee he and his family would comply with the conditions in the staff report and asked how properties are formally bound; staff said a notarized and recorded deed restriction or lot-binding agreement is required.
The permit was presented under Sawyer County Code of Ordinances, Appendix D, section 4.26(2), which ordinarily restricts accessory structures from being sited on a parcel that does not contain the principal dwelling. Staff said the location on the adjacent parcel is proposed as an exemption because siting the structure on the primary-lot would violate lakefront setback requirements and placing it across the road would reduce impervious-surface impacts to the lake. Staff also noted the structure would be approximately 275 feet from the lake shore and that the parcel meets minimum square-footage and other county zoning requirements.
Conditions listed in the staff report — incorporated into the committee's approval — include: compliance with setbacks and county requirements; no habitable area or commercial use in the accessory structure; adherence to size limits applicable if the property were platted; removal of the existing garage on the vacant lot within one year of the land-use permit; and a notarized deed restriction tying the two parcels together (preventing separate sale) as required by the town. The committee referenced the town's approval and findings of fact when voting.
Mr. Schuman moved to approve CUP 24-16 "including J's staff report and all those conditions" and to adopt the findings of fact; Mr. Savitzky seconded. The clerk recorded a roll-call vote in which Ron Buckolz, John Sski, Tweet Schuman and Marshall Savitzky voted yes; the motion carried.
The committee moved on to the next agenda item after recording the approval; no appeal or remand was recorded at the meeting.
