Members approve written decision in Beechwood hearing; attorney says appeal to superior court expected

Members at the meeting voted to approve a written memorandum decision and an accompanying notice of order that formalizes the panel’s ruling in the Beechwood hearing.

Rob Remer, who said he drafted the memorandum decision, summarized the document and the edits made after the hearing. "I tried to put something together based on the hearing that we had and the four votes in favor," Remer said as members reviewed stylistic redlines and a separate notice of order suggested by town council.

The decision was moved, seconded and approved by the membership. The written memorandum and the notice of order are intended to record the panel’s formal disposition following the hearing.

When a member asked about appeals, an attorney present said the next step would be an appeal to the trial-level superior court. "They'll appeal to the trial court, the superior court, is my understanding. And they are planning to appeal. Council's already informed me," the attorney said.

Members noted the likelihood of additional Beechwood-related filings and said they will schedule future meetings as needed to address any new complaints.

The meeting record shows the board approved the memorandum decision and notice of order after discussion of the draft and stylistic changes; the group then proceeded to other agenda items and adjourned.

Next procedural steps include formalizing the approved written materials for the public record and monitoring any appeals to the superior court.
