The Zoning and Building Standards Board of Appeals unanimously approved a request June 24 to transfer a 20-foot strip of land to Duras Leasing in order to align a parcel’s legal description with longstanding use.
Attorney Cara Dodson, representing Duras Leasing, said the strip has been treated in practice as part of Duras Leasing’s parcel for more than 20 years but that an erroneous legal description in a prior conveyance left the strip titled to the adjoining owner. Dodson said the adjacent owner has agreed in principle to transfer the strip once the board approves the split.
Dodson described the history: county surveys and maps had treated the strip as part of Duras Leasing’s parcel; at a later sale the deed referenced an earlier plat and the legal description mistakenly conveyed the entire parcel to the neighbor. “...the incorrect legal description was used,” she said, and the current filing seeks to correct the record by transferring the 20-foot strip (parcel cited in the motion as parcel 928299) to Duras Leasing.
Board members asked whether the strip is used for parking and whether there are plans to expand the building; the attorney said the strip is used for parking and that there are no plans to expand the building. After a motion and second the three members present voted yes on the roll call and the variance passed.
The action resolves a long-standing title discrepancy, and the board recorded that the transfer will align legal ownership with the property’s practical use. The application was listed on the agenda as ZBA26-7 for 8:15 East Maple Street; the transcript identifies parcel numbers and a multi-decade common ownership history.
