The Rockport Planning Board voted unanimously to approve a final/minor subdivision application for Ledgewood Commons (parcel described in the application as 6 Madlin Lane), granting the waivers requested on the plan and placing a condition that the director of public works provide written sign-off regarding road design/conformity.
Applicant representatives (Ed Libby and Caleb Lincoln of Lake City Holdings, with Gartley & Dorski on the plan) presented the subdivision as largely administrative: the parcel was previously developed, no new construction is proposed as part of this approval, and applicants asked the board to grant waivers for items such as detailed private-way cross-sections and certain stormwater plan submissions on the basis that the road and site improvements already exist.
A written public comment from neighbor Timothy (Tim) Kerin was read into the record. Kerin said his driveway that serves 600 Commercial Street has long existed and that survey materials appear to show his gravel edge approaching or crossing a boundary; he requested the board ensure his access rights are not prejudiced by the subdivision. Planning staff and the applicant noted plan annotation of a six-foot maintenance/repair easement "for the benefit of Timothy Kerin" and an existing 20-foot undisturbed buffer along the edge of the parcel; staff said these features and the deed materials provided address his concern.
The board considered the enumerated waivers (stormwater/erosion controls for areas already built, private-way documentation and other listed items) and voted to grant them. The board then voted to make subdivision approval conditional on a written confirmation (or letter) from the director of public works related to road layout/standards (item 28 on the submission checklist) and subsequently approved the minor subdivision with the waivers and that condition. The motions and waivers were recorded and the plan will be signed as part of the final record.
Board members recorded that the waivers are routine for previously constructed features and that the condition is intended to ensure public-works review is formally in the file before final plan signing and recording. The applicant was thanked and asked to coordinate record signatures with town staff.
Votes and implementation: waivers granted and final minor-subdivision approval with the public-works condition were recorded as passed; staff will collect the director-of-public-works letter and finalize plan signatures for recording.
