TWC moves forward proposed rule updates for unemployment insurance, OIB and procurement

The commission authorized publication of proposed rule amendments for 40 TAC Chapter 815 (unemployment insurance), Chapter 853 (Independent Living Services for Older Individuals Who Are Blind) and Chapter 858 (procurement and contractor rules), each for a 30-day public comment period with staff authority to make non-substantive edits for publication.
At its June 28 meeting, the Texas Workforce Commission advanced several sets of proposed rule amendments for publication and public comment.
Reed O'Bryan of TWC’s Office of General Counsel presented the proposals. For Chapter 815 (unemployment insurance), staff recommended clarifying physical and electronic mailing-address requirements, consistent hearing procedures, and other general clarifying changes; staff asked to publish the proposal in the Texas Register for a 30-day comment period and to be allowed to make minor non-substantive edits for publication compliance. Commissioners raised clarifying questions about whether Department of Aging and Disability Services (DADS) training had been assumed by other agencies and whether the definition of "appear" left discretionary determinations; staff committed to follow up on those items.
Commissioners approved publication for Chapter 853 (Independent Living Services for Older Individuals Who Are Blind), which aligns rules with the OIB Policy Manual and federal regulations, and for Chapter 858, which restructures contractor recoupment, suspension and debarment rules and adds a fraud definition. Each proposed rule will be published for a 30-day public comment period and staff may make non-substantive edits to comply with Texas Register requirements.
Commissioners indicated they would hold Chapter 815 for further clarification on training-source transfers before finalizing publication for that chapter.
Ending: Staff will publish Chapters 853 and 858 for a 30-day comment period and will follow up on outstanding questions about Chapter 815 training sources and appearance language before publishing that chapter.
