Township Solicitor Zachary Sivertsen presented the appraisal report, a draft right‑of‑way purchase agreement and a resolution authorizing eminent‑domain acquisition. Property owners Mr. and Mrs. Kerver attended and told the board they had not received two mailed letters and an earlier offer to purchase from the developer and said they first learned of the township's certified‑mail notice when they received it directly from the township.
The Kervers expressed concerns about language in the draft agreement and asked for more time to review the documents and consult with their counsel. The Board agreed to defer further action and indicated it would attempt to reach an amicable agreement before pursuing eminent domain; the matter will return to a future meeting if no agreement is reached.
No resolution was adopted at the May 12 meeting; the Board left open negotiation and further consideration.
