Commissioners clear consent agenda and authorize hiring for deputy county attorney

At its Dec. 16 meeting, the Carbon County Board of Commissioners approved a consent agenda that bundled variances, grant certificates and administrative items and authorized the county attorney to recruit and hire a deputy county attorney.
The consent agenda approved included variance requests for Beartooth Crane (about $1,400), Wharton Asphalt LLC ($14,415), Knife River & CGR ($208,750) and a Secure Warrant request ($3,150); certificates of compliance for Roberts Water and Sewer District well improvements ($275,000) and Edgar WW Per ($40,000); the county’s marijuana local tax Q1 breakdown for 2025–2026; commissioner approvals for Nov. 30–Dec. 13, 2025 and minutes from Nov. 25, 2025; a 160-hour sick-leave grant request and owner-representative services for the Bischoff Pit permit application.
County Attorney Alex Nixon told the board he plans to cancel one outside contract with Pierce and limit the Dry Creek contract to make the deputy county attorney salary more competitive. Nixon said former Deputy Shannon Foley intends to apply for the posted position and Civil Attorney Jacque Papez said the new deputy could assist with Matriarch matters.
Commissioner Bill Bullock moved and Commissioner Scott Miller seconded to approve the hiring authorization for the deputy county attorney; the motion carried. The board also approved the consent agenda by motion.
What’s next: County administration will proceed with recruitment under the approved hiring authorization and will complete contract adjustments described by the county attorney to free salary funds.
