Resident Penn Rhodeen sought Selectmen'approval for an outfall (OBD) pipe to run through a town culvert under Indian Point Road and asked for assurance the item would appear on the 2021 Annual Town Meeting warrant.
Town Manager Kathleen Billings-Pezaris and Selectmen told Rhodeen the town is reluctant to allow private discharge lines to use town culverts because a town-maintained culvert can become the town's responsibility if it fails or clogs. "We prefer property owners install their own culvert sleeve and maintain it," Selectman Evelyn Duncan said, citing maintenance and liability risks to the town.
The Selectmen discussed the need for recorded easements from adjacent landowners and said the matter may need to appear on an Annual Town Meeting warrant if an easement or formal permission is required. TM Billings said she would follow up on legal and permitting steps and consult with Maine Municipal Association guidance.
No formal easement was recorded at the meeting and the board did not approve a road cut or permanent town easement; they directed staff to gather necessary legal documentation and route the request through the appropriate administrative or town-meeting processes.
Next steps recorded in the minutes included confirming adjoining-easement documentation, clarifying DEP or other regulatory requirements for OBD work, and returning the issue to the board once documentation is complete.
