Rules committee moves proposed Fairfield County jail contract to council for first reading, seeks county clarifications

Baltimore Village’s rules committee voted to add Ordinance 2026-21 — a proposed contract authorizing the mayor to arrange jail housing with Fairfield County — to the council agenda for a first reading while members seek clarifying language from county officials.

Members traced the history: the village previously held a one-year contract with the county in 1998 to house Mayor’s Court prisoners but had not had a standing arrangement since. The county recently adopted a resolution that could prevent the county jail from accepting prisoners from Baltimore Mayor’s Court; village members said the mayor and village staff were not consulted before the county action.

Committee members agreed the draft needs additional review with the county prosecutor’s office and sheriff to ensure the contract language aligns with both parties’ expectations. The solicitor noted the draft includes emergency language but advised the committee it did not need to adopt emergency measures at this time; instead, the committee moved the draft to full council to allow time for the county to provide final verbiage and for village staff to reconcile concerns.

The committee also discussed operational questions — for example, whether arrests by county deputies in the village lead to processing through the village mayor’s court — and confirmed some procedural distinctions about warrants and state-code filings. The draft ordinance will appear for further readings at council and may be amended after village staff obtains county clarifications.
