Danvers conservation staff reports timeline, corrective measures for 35 Doty Avenue enforcement order

The Town of Danvers Conservation Commission received a status update April 23 on enforcement action DEP #14-0883 for 35 Doty Avenue.

Emily Beatrice, the commission’s staff planner, said the property owner must remove a 1,200 sq ft sports court and restore the area to lawn, move granite boundary markers that were placed too far into wetlands, plant 375 sq ft of upland shrubs, install a 100 sq ft pollinator garden, and submit a new as-built plan documenting the corrected work. Per an email summarized for the commission, applicant representative Bob Griffin reported the corrective work is expected to be completed by June 6, 2026, after which staff will schedule a site visit.

Beatrice confirmed to commissioners that the granite stones will be moved outward to properly delineate the wetland boundary and that a new as-built plan will be required before staff can recommend issuance of a Certificate of Compliance. She also noted that a dock on the property falls under a separate Order of Conditions and may require an after-the-fact filing.

Commissioners asked for clarifications during the check-in. Peter Wilson sought details about the granite markers and the court removal; Michael Splaine pressed for differences between the original and updated as-built designs; and Paul McNulty confirmed there will be a site visit prior to issuing a Certificate of Compliance. Chair Mary Haight concluded the discussion; no formal vote was required at the meeting.

Next steps: staff will follow up with the applicant representative, schedule a site visit after the June 6 completion date, and verify corrections before issuing a Certificate of Compliance that would lift the enforcement order.
