Homeowners Majlinda and Spartak Vaka told the commission that clearing and foundation work had begun under a valid building permit before they realized the property’s proximity to an intermittent stream; they said work stopped when they were notified. The applicants filed a stormwater report proposing a permeable driveway and an infiltration system. Commission members and staff said a site visit was necessary to verify stream location, wet areas and to evaluate DEP technical comments.
Neighbor Joella Stockwell raised concerns about proximity to a stone wall and wet areas between properties; the applicants said the house meets zoning setbacks from the wall and they do not intend to disturb it. Staff planner Emily Beatrice noted that DEP technical comments are uncommon and underscored that building‑permit review does not automatically flag Conservation issues.
The commission voted unanimously to continue the matter to its April 23 meeting to allow a site visit to take place. The commission also scheduled enforcement follow‑up for 35 Doty Ave and noted two alternate vacancies; candidate Mike McCarthy attended the meeting and will meet with the Town Manager as the next step. The meeting adjourned at 8:11 p.m.
