The Town of Danvers Conservation Commission voted 5–0 on April 9 to issue a positive Determination of Applicability for an Abiomed proposal at 54 Cherry Hill Drive and to require the filing of a Notice of Intent (NOI), saying the scale of work is too large for a Request for Determination of Applicability (RDA).
Representative Danell Baptiste (High Point Engineering) and architect Cindy Murphy (Genesis AEC) described roughly 9,000 square feet of new pavement and about 267 total parking spaces in the project, with about 23–24 new spaces lying within jurisdictional buffer zones. Baptiste said the design includes a stormwater infiltration system intended to capture run‑off and that no work would disturb the wetland itself.
Commission members expressed concern that the excavation and extent of new pavement merited stronger oversight than an RDA allows. Peter Wilson and other commissioners cited inconsistency in granting waivers under an RDA process and said the proposal’s scope made a full NOI appropriate. Baptiste said the applicant had hoped to avoid a full NOI filing but would comply if required.
The commission voted unanimously to require the NOI and close the hearing. The requirement obliges the applicant to provide fuller plans and technical review under the NOI process before the commission can make a final permitting decision.
