Council to rely on ethics board and request records in CO25-282 inquiry

At a June 22 workshop, the Bangor City Council discussed and acted on next steps after receiving an advisory opinion from the board of ethics on CO25-282, a matter concerning Councilor Mor's conduct during an August historic preservation committee meeting.

City legal staff told the council there is no statutory procedure currently for how the council should process advisory opinions and urged the council to decide whether to rely on the ethics board's investigation or conduct its own. A councilor moved that the council rely on the board of ethics' investigation; that motion was seconded and put to a vote.

Council then considered whether to review the ethics board's packet before deliberation. A separate motion to request the ethics board's investigation records passed; city staff agreed to gather and send the records to council members prior to the next workshop and the item will be scheduled for deliberation at that meeting.

The ethics board's advisory opinion is not itself a final council determination: legal staff reminded the council that advisory opinions are advisory and the council may, if it chooses, conduct its own investigation. Councilors expressed differing views on whether the council should review witness statements and the board's summaries before any deliberation.

Why it matters: CO25-282 involves alleged conduct by an elected councilor during a public meeting and raises questions of council process, ethics oversight and how advisory opinions translate into council action. The council's decision to request records and place the matter on a future agenda sets the next procedural step.
