Planning staff told the board the review committee had recommended denial because the request involved a quit‑claim transfer that the committee felt could be an attempt to sidestep subdivision regulations in a platted subdivision. Staff noted the parcel contains a commercial shop and that the owners sought to separate the commercial portion from residential acreage to secure a construction loan. The planning presenter said the county’s subdivision regulations and recent state law changes create a distinct process for family transfers in platted subdivisions and that DEQ approval would be required before a new lot could be created.
The property owner who spoke at the meeting said lenders had refused to provide a construction loan without the parcel separation and that local surveyors recommended the transfer route the owner pursued. Commissioners discussed the potential for creating a precedent and the need to prevent routine circumvention of regulations, but decided to allow the applicants to use the family‑transfer exemption and to bring back a subsequent action item with specific conditions for approval (including DEQ review and any necessary conditions tied to the Courtney Ridge plat).
The board will require the applicant to obtain required DEQ wastewater approvals and any other conditions applicable to amended plats in platted subdivisions before the division is finalized. Staff said a separate action item with specific approval language and conditions will be scheduled for a future meeting.
