Lincoln County commissioners approved an amended plat that uses the family-transfer exemption to move 15.13 acres of a 16.85-acre parcel from Daniel Green to Olivia Green.
Planning staff explained the request submitted by Breen Ridge Surveying and reminded the board that a change in state law allows family transfers in platted subdivisions but prevents the commission from imposing new conditions on such transfers. Staff recommended approval with the original subdivision’s conditions carried forward. The planner said DEQ approval will be required for both parcels and that any recorded covenants would continue to apply.
The planner listed standard conditions from the original Courtney Ridge approval, including that surveys be prepared according to ARMS, taxes be paid, certification by a licensed title abstractor identifying owners and lienholders, and written consent from owners and lienholders. "If there are violations of state statute for junk vehicles or environmental issues, those would be handled through complaint processes," the planner said.
Commissioners acknowledged receipt of a letter from neighbors (the Warers) raising concerns about noise, air quality and junk vehicles related to a pre-existing mechanic business on the property; the board said those statutory and DEQ enforcement mechanisms remain available. One commissioner noted the county lacks zoning authority that would prohibit commercial activity in that subdivision and reiterated that covenants and DEQ approvals will govern compliance.
A motion to approve the planning department recommendation passed by voice vote. Daniel Green, participating online, thanked the board and confirmed awareness of septic and DEQ requirements.
What happens next: staff will issue a confirmation letter outlining conditions that continue to apply and will check with the clerk and recorder about recording subdivision covenants.
