Elkhart closes consent order after industrial wastewater permittee returns to compliance

The Elkhart City Board of Public Works on June 2 voted to close a consent order for Elkhart Environmental Processing after staff said the company addressed repeated 2025 FOG (fats, oils and grease) violations and implemented corrective measures.
Steve Brown, public-works staff, briefed the board on the pre-treatment program and said the permitted facility conducted a best-management-practices program, implemented an engineering evaluation plan and corrective action plan, and increased FOG monitoring frequency from monthly to weekly. "Since that time Elkhart Environmental Processing has successfully conducted best management practices, engineering evaluation plan, corrective action plan and also enhanced more frequent FOG monitoring," Brown said, adding that the company is now in compliance and staff recommended closing the consent order that the board approved Jan. 20, 2026.
The board asked if any company representatives were present; none offered comments. Following staff recommendation, the board voted to close the consent order.
The board’s action removes the formal compliance order from the city’s agenda and records the facility as meeting permit terms under the newly implemented program.
