Pembroke planning board approves pond permit for 196 Main Road to address drainage

The Town of Pembroke Planning Board voted Aug. 28 to approve a special use permit and site plan allowing a pond to be dug at 196 Main Road to address drainage affecting the homeowner and a neighboring property.
Chairman David Knupfer opened the public hearing at 7:02 p.m.; applicant Kevin Mulaniff and his contractor, Fred Climato, were present and no members of the public spoke. Knupfer read the legal notice and the board recorded that notices had been mailed to 11 residents within 500 feet of the parcel.
Contractor Fred Climato said the work would excavate an existing depression to create a small pond and use natural inlet and outlet flows to relieve runoff from a neighbor’s pond that has been flooding Mulaniff’s property. Climato said the house sits about 3½ feet above surrounding grade and is nearly 600 feet from the road.
Planning staff noted the application required referral to the county; the county approved the proposal with a modification that the applicant provide documentation from the New York State Department of Environmental Conservation about the project’s potential impacts on threatened and endangered species. Knupfer also summarized a letter from Soil and Water concluding the site was adequate for pond construction.
The board closed the public hearing at 7:14 p.m. On a roll-call vote the board declared a negative determination under the State Environmental Quality Review Act (SEQR). The board then voted to approve the special use permit and site plan for the pond. The roll call on the permit recorded five ayes and one nay (Greg Kuras voting nay); the motion carried.
The meeting record shows other routine business was nil; the meeting adjourned at 7:16 p.m. The minutes of the Aug. 28 meeting were approved by the Planning Board on Sept. 25, 2024.
