The Papillion Planning Commission on June 24 voted 7-0 to recommend approval of the Ashberry Creek 2 Replat One final plat (FP-26-00008), a subdivision application that adjusts several lot lines and slightly widens some parcels.
Pat Sullivan, speaking on behalf of the applicant, told commissioners the changes are largely market-driven tweaks to an earlier final plat. “This is a final plat that’s a long time coming,” Sullivan said, adding that a few lots have been resized but the overall plan remains largely the same. Engineering consultants Randy Kush and Mark Torzon were on hand to answer technical questions.
Commissioners asked about the mix of housing types and whether a single builder would dominate construction. The applicant said the original developer was a subsidiary of BHI Development and that the revised product mix increases the share of the higher-end “Woodland” product to roughly two‑thirds and retains about one‑third of the mid‑level “Pinecrest” product. “Having that varied level will help move this forward,” an applicant representative said, explaining the change is intended to improve sales velocity and accommodate larger ranch footprints.
Sullivan and the consultants said covenants will be used to promote a cohesive neighborhood appearance. On questions about homeowners associations and emerging legal issues—such as solar-panel rules and short‑term rentals—the applicant said the development will follow applicable law as it evolves and will likely adopt a similar HOA model used in nearby projects.
A commissioner moved to recommend approval, citing consistency with the approved preliminary plat, compatibility with adjacent uses, compliance with zoning and subdivision regulations, and general conformance with the comprehensive plan. The motion included a condition that the applicant resolve the planning department contingencies listed in the staff report before the item advances to city council. The motion was seconded and approved by a 7-0 voice vote.
Next steps: the recommendation will be forwarded to the Papillion City Council; the commission’s recommendation is contingent on the applicant addressing the staff report contingencies prior to council action.
