County grants preliminary approval to Elk Sky four-lot subdivision, adds groundwater notice condition

The Lincoln County Board of Commissioners granted preliminary plat approval Jan. 7 to the Elk Sky four-lot residential subdivision north of Eureka, owned by Christopher Christensen.
Planning staff reviewed the project, noting four equal five-acre lots, existing single-family residence on one lot, access patterns (lots 1 and 2 off River Road, lots 3 and 4 off Airport Road), and limited impacts to agriculture and natural resources. Staff recommended 19 standard conditions addressing road approaches, covenants, noxious-weed management and utilities.
A newly emphasized condition requires filing DNRC Form 602i (Notice of Intent to Appropriate Groundwater). Planning staff said state rule changes and litigation around exempt wells make this filing necessary; DNRC may impose conditions (for example, limits on bedrooms or lawn irrigations) to keep new wells within allowable use.
Commissioners approved the preliminary plat with the 19 conditions. Staff noted that wells on the parcels currently showed varied production (8 to 30 gpm) and depths between about 110 and 267 feet, and that an unrecorded 800-foot dry hole exists nearby; the DNRC filing will help future applicants and county staff understand permissible uses.
