Planning commission recommends conditional approval for Penn Home & Farm lot addition

On Sept. 4 the Salem Township Planning Commission recommended conditional approval of an application by Penn Home & Farm LLC to add Lot 1 as additional side yard to the property of John and Patricia Kilpatrick (Tax Map No. 57‑12‑00‑021).
The commission’s approval recommendation, made by Paul Holleran and seconded by Connie Mattei, was unanimous among the members present. The motion followed a presentation by Tom Spears, identified in the record as the property owner and sole owner of Penn Home & Farm LLC, and questions from a nearby resident about access to the rear parcel.
Resident Ken Brozack asked whether a right‑of‑way exists to reach the rear parcel from Mark Drive. Township Solicitor Gary Falatovich said the original Garden Courts plan from the 1960s referenced two 50‑foot streets that were never dedicated to the township or opened on the ground and that no easement was reserved in that recorded plan. Falatovich said the applicant also owns the adjacent parcel (Tax Map No. 57‑12‑00‑0‑032) and will access the back parcel from that property.
The Planning Commission listed a set of technical plan conditions that must be satisfied before the plan can be finalized. They include showing a 30‑foot front building setback from Mark Drive and 10‑foot side and rear setbacks; labeling the driveway to the Kilpatrick dwelling; adding Mark Drive’s right‑of‑way width and identification number; showing pre‑ and post‑subdivision acreage; identifying any sanitary sewer easements; including a note that Penn Home & Farm owns 54 Mark Drive (parcel 57‑12‑00‑0‑032) and that access to the rear parcel is available from that property; providing Department of State corporate filings that identify the LLC’s sole member; and obtaining required approvals from the township SEO and the Pennsylvania Department of Environmental Protection.
The commission’s motion recommended approval subject to these and other technical revisions and to the Kilpatricks’ signature on the plan. The commission did not record a vote by any other member beyond the two who made and seconded the motion; Vice‑Chair John Durco was recorded as absent.
The commission’s recommended conditions are procedural requirements for the plan record and do not by themselves alter property title or grant public easements. Final plan approval will depend on documentation and the required external agency approvals noted by the commission.
