Neighbor appeals fence permit; council denies exception request and grants two special building permits

Resident Devin Corbisier asked the council to consider revoking a fence permit at 306 Elk Street, saying the fence sits "8 1/2 inches away from his home" and prevents him from mowing. "He isn't even able to mow," the minutes record. Chief Nixon advised that the dispute is a civil matter and suggested pursuing a district-court variance or easement. The council did not move on the appeal and the item died for lack of motion.
Separately, Barb Gregg of 712 River Street requested a special permit to have the "good" side of a fence face her house. The council denied that request, citing the municipal ordinance requiring posts and supporting members face the owner's side. Councilmember Mike O'Hara moved to deny the permit and the motion passed unanimously.
Council approved two special building permits. Teena Franzen moved to approve a special permit for Greg and Mary Althoff at 407 River Street, where the house sits three feet off the sidewalk; the motion carried. The council also approved a special building permit for Ryan Lott at 603 Broad Street, where the porch is 18 feet, 3 inches from the curb.
Greg and Mary Althoff also asked to live in a camper at their rental property at 301 Elk Street while they rebuild a house damaged by lightning; the council approved the temporary occupancy during construction.
The council's actions on the permits and the camper request were recorded as unanimous votes. No formal enforcement action was taken on the 306 Elk dispute during the meeting.
