Malden reclassifies clerk and treasurer as non-exempt; overtime budget request fails

The Malden City Council voted Nov. 18 to reclassify two salaried positions as Non-Exempt under Department of Labor overtime protections.
City Administrator Ivone Smith said the City Clerk/City Collector and the City Treasurer/Finance Officer do not meet the salary threshold under new rules and recommended both positions be converted to hourly (Non-Exempt) status effective Jan. 1, 2025. Council Member Jenkins moved the change; the motion passed 5–2. Council Member Joyce and Council Member Beckett voted no.
Smith then recommended budgeting 36 hours of overtime for those positions in the 2024–25 fiscal year. Council Member Jenkins moved to add the overtime to the budget, but the motion failed by poll vote, 3–4. The transcript shows council members voiced concern about potential overtime abuse and about how overtime would be controlled.
Separately, the council adopted an updated smoking policy (including vapes) and a policy granting double time pay for employees called in on holidays; both measures passed unanimously earlier in the meeting.
