Commission sets July 14 hearing on amendment to allow email notice for additional mining hours

At its June 9 meeting the Town of North Canaan Planning and Zoning Commission voted to hold a public hearing on July 14 to consider a proposed text amendment that would add email as an acceptable means of notifying the Zoning Enforcement Officer when mining operations must occur outside the regulations’ listed hours.
Zoning Enforcement Officer George Martin provided the request to the commission via email and read the report into the record. Chairman Mike O’Connor read the proposed regulatory text into the minutes: normal hours would remain Monday–Friday from 7:00 a.m. to 5:00 p.m. and Saturday from 8:00 a.m. to 1:00 p.m.; no mining or blasting would be allowed on specified legal holidays; the amendment would also allow an additional 200 hours of operation in industrial zones for emergencies or delays if the operator faxes or emails the ZEO in advance indicating when operations will occur, how many hours they will be and the total hours used that calendar year.
After a brief discussion Dalton Jacquier moved to set a public hearing on the amendment for July 14 immediately following the other scheduled hearing at 7:00 p.m.; Cooper Brown seconded and the motion carried. During public comment Robert Sprague asked how adding email to the notification methods would resolve the specific problem that had prompted the proposal; Chairman O’Connor said the commission would discuss that question at the next meeting.
Next steps: the commission will hold a noticed public hearing on July 14 where the amendment text, operational constraints and public concerns will be considered. The minutes do not record any vote on the substance of the amendment beyond scheduling the hearing.
