Chris, the district's Title IX compliance lead, told the committee the district consulted counsel (Shipman & Goodwin) and recommended adopting Shipman's model policy. He said the rule broadens Title IX's coverage to school-related activities outside campus, expands protected characteristics, requires all employees to report instances of covered discrimination to the Title IX coordinator, and relaxes certain 2020-era litigation-style investigation procedures. Chris said the district will identify one district-level Title IX coordinator (himself) and is working to ensure building-level coordinators and mandatory staff training are in place by early to mid-October.
During discussion, board member Becky moved to postpone action, arguing that pending federal litigation and judicial injunctions targeting the rulemaking process mean the district should wait. That motion was not seconded and did not proceed. Chris clarified that ongoing litigation seeks injunctions against federal agencies, not against individual school districts, and that counsel advised adopting the final rule while monitoring developments.
After additional questions about how investigations would proceed under the new rules and how coordinators would be designated, the committee voted to pass Resolution 08-13-24:53 (adopting Policy 4000.1) by a tally of 4 in favor and 1 opposed.
The committee directed staff to finalize accompanying regulations and to return with details on local coordinator assignments and the district's staff-training rollout timeline. The policy takes effect as adopted; legal developments at the federal level may alter obligations and counsel advised the district to monitor any changes.
