At a special meeting Oct. 28, 2025, the Town of North Canaan Zoning Board of Appeals reviewed a request concerning 133 Railroad Street and advised alternatives to a zoning variance.
Mr. Rovelto, who presented sketches for the parcel, told the board “With the 2 entrances it does not allow for the 10ft setback from the new property line the way it has been drawn.” The board examined the map and sketches and discussed options to allow the parcel split to proceed without a variance.
Board members and Mr. Rovelto discussed three options the board offered: adjusting the new property line to meet the 10-foot minimum driveway setback; relocating one or both driveways under a State permit; or, if neither option is feasible, pursuing a variance as a last resort. The board noted that the parking lot is included in the 10-foot setback calculation under the applicable local regulation as discussed in the meeting.
The board did not vote on a variance. Mr. Rovelto said he has a potential buyer and will submit a final survey to the board for the file once completed. The board’s guidance leaves the applicant with non-variance paths to attempt before seeking formal relief.
