The Franklin County Board authorized a closed attorney–client strategy session to discuss the pending lawsuit The Landing at SGI LLC v. Franklin County (Case No. 2025-CA-56), County Attorney Michael Shuler told commissioners on March 4.
Shuler cited the statutory authority allowing a recorded, closed session for settlement negotiation and litigation strategy. The Board set the session for April 1 at 2:00 p.m. in the commission meeting room. The statute requires a certified court reporter to record the session; the transcript will be filed with the clerk and become part of the public record once litigation concludes.
Board action: Commissioner Jessica Ward moved to authorize the executive session at the specified place and time; Commissioner Ottice Amison seconded and the motion passed unanimously (5-0).
The Board's public vote to authorize a closed session is the statutorily required step allowing legal counsel to meet with commissioners in a closed setting to discuss litigation strategy.
