Pella Council discusses UTV rules after state code change; staff to return with ordinance options

The City Council heard a detailed presentation from the police chief and staff about off‑road utility vehicles (UTVs) and all‑terrain vehicles after a change in Iowa Code left local rules ambiguous.

Police explained that Iowa Code treats UTVs as motor vehicles with registration, operator age, licensing and lighting requirements, but a recent statutory revision also specifically allows cities to regulate whether registered UTVs may operate on streets within their corporate limits. That change created enforcement uncertainty—police said the department had refrained from routine stops where ambiguity existed and sought council direction.

Chief testimony covered safety differences between portable and mobile radios and broader enforcement considerations (seat belts, turn signals, proof of insurance and speed limits). Several council members described seeing UTVs operating downtown and expressed safety concerns—particularly about youth drivers and vehicles without proper equipment. Other speakers noted UTV owners who register vehicles and equip them with safety gear and argued for reasonable accommodation.

Council direction: members asked staff to update the prior analysis from about two years ago, gather comparative ordinances from peer Iowa cities, and return with options for council consideration. Several councilors signaled a preference to prohibit UTV operation on city streets, with an option to explicitly enumerate permitted streets or exemptions (for public safety, city operations, or campus/college uses). No ordinance vote was taken at this meeting.
