Planning board endorses Elwell ANR plan as not requiring subdivision approval

The West Newbury Planning Board unanimously endorsed an approval-not-required (ANR) plan submitted for the Elwell property at its Jan. 6 meeting, with board members saying the plan met application requirements and did not appear to trigger subdivision review.
Planner Chris presented the plan as a "simple land swap" between family members and told the board it did not affect zoning and was properly prepared. Board members questioned whether any structures existed on the parcels; staff said the plan drew no structures and the board would accept the representation on the face of the plan.
Board members also flagged the 21-day statutory deadline for acting on ANR submissions and discussed options if the date or completeness is unclear. The planner said he would follow up with the applicant to confirm submission timing if the board chose to continue the matter. Given the board’s comfort with frontage and access and the absence of structures on the plan, a motion to endorse the ANR as not requiring approval under the Subdivision Control Act carried on a roll-call vote: Anne Bardin, Ray Cook, Deb Hamilton, Brian Murphy and Rob Phillips voted yes.
No public comment was recorded on the ANR item. Staff will confirm the submission date and notify the applicant if additional information or resubmission is required.
