Garden City’s council voted unanimously on June 22 to adopt Ordinance 1066-26, granting InterMountain Gas Company a 20-year extension to its franchise to operate gas transmission and distribution facilities in the city.
City staff said the ordinance largely mirrors the previously published draft; counsel negotiated a provision requiring the utility to provide 30 days' notice prior to any automatic renewal so future elected officials have an opportunity to revisit terms. The ordinance also requires the grantee to restore city streets and alleys damaged if the franchise is surrendered, maintain insurance, provide annual reports, and comply with safety regulations.
Council moved to adopt and publish the ordinance by roll call; votes by Council members Paige, Raspersonson and Carver Herbert were recorded as 'yes' and the measure was adopted. Staff said the franchise and code provisions will govern the city's relationship with the utility for the next two decades unless further action is taken.
The council also recorded appreciation for staff and the utility for being responsive during negotiations.
