Warrick County Drainage Board declines to fund Yellowstone PUD reroute, cites cost and precedent

The Warrick County Drainage Board voted to decline a request to use county funds to reroute runoff for the Yellowstone planned unit development, citing cost estimates and concerns that paying for work on private property would create an ongoing maintenance obligation.

Agency official (speaker 6) presented a report and a conservative upper estimate of about $20,000, saying “not to exceed about $20,000,” and explained that the county’s obligation ends at public right-of-way and that private subdivision streets and drainage typically remain private responsibilities. Board members repeatedly raised the risk that spending public dollars on privately owned drainage could set a difficult precedent.

Why it matters: Board members said committing county money could create a duty to maintain the new infrastructure and expose the county to future liability or litigation. One committee member argued a court order could change obligations, but until then the county should avoid investing taxpayer dollars in private areas.

During discussion, committee members debated whether a split-cost contract could preserve county interests while avoiding future maintenance responsibilities. The board rejected that approach, with Committee member (speaker 3) moving that the county not fund the private drainage work and Committee member (speaker 10) seconding. The motion carried by voice vote.

The vote leaves the Yellowstone PUD proponent to pursue private options or seek a legal determination; staff did not record a formal dollar commitment by the county. The board also noted it will continue to review legal guidance before considering similar requests.

The board did not adopt any funding agreement at the meeting.
